1. Ordering Process
In our online shop, you can add items to your basket by clicking on the "Add to Basket" button, without any obligation to purchase. You can then review the contents of your basket and remove items at any time. You can initiate the ordering process by clicking on the "Place Order" button. You can order as a guest or create an account.
You can also create a customer account or log in as a registered user. You will then need to choose a payment method. On the "Place Order" page, you can review the details of your order again. You can go back at any time and modify your information or interrupt the ordering process by leaving our website or closing your browser. You are only committed to purchasing when you click on the "Place Order" button and complete your payment. Once the payment is confirmed, we will send you a confirmation of it by email.
2. Definitions
In these general terms and conditions, the following definitions apply:
Entrepreneur:a natural or legal person who is a member of BeCommerce and offers consumers products and/or services at a distance
Consumer:a natural person who does not act in the course of a profession or business and who enters into a distance contract with the entrepreneur
Contrat à distance :agreement by which, within the framework of a system organised by the entrepreneur for the distance selling of products and/or services, up to and including the conclusion of the contract, exclusive use is made of one or more distance communication techniques
Distance communication technique:resource that can be used for the conclusion of a contract and does not require the simultaneous presence of the consumer and the entrepreneur in the same place
Withdrawal period:period during which the consumer has the right to exercise their right of withdrawal
Right of withdrawal :possibility for the consumer to withdraw from the distance contract within the allotted withdrawal period;
Day:calendar day
Durable medium:any means allowing the consumer or the entrepreneur to store information that is addressed to them personally in such a way as to allow for subsequent consultation and an unaltered reproduction of the stored information.

4. Applicability
These general terms and conditions of sale (GTC) apply to all orders placed on the online shop.
Our offers are addressed solely to consumers.Before the conclusion of the distance contract, the text of these general terms and conditions is made available to the consumer. If this is not reasonably possible, it is indicated before the conclusion of the distance contract that the general terms and conditions can be consulted at the entrepreneur's premises and they will be sent free of charge at the consumer's request as soon as possible.
If the distance contract is concluded electronically, the text of these general terms and conditions can be made available to the consumer electronically in such a way that it can be easily stored by the consumer on a durable data carrier. If this is not reasonably possible, it will be indicated, before the conclusion of the distance contract, where the general terms and conditions can be consulted electronically and that they will be sent electronically or otherwise free of charge at the consumer's request.
Your personal account: You can create an account for our online shop to simplify the administrative processing of your orders, to view your order history, to save items for later, to update your wish list, and to review your favourite items.
5. The offer
The offer contains a complete and accurate description of the products and/or services offered. The description is detailed enough to allow the consumer to properly assess the offer. If the entrepreneur uses images, these are a true representation of the products and/or services offered. Obvious mistakes or errors in the offer do not bind the entrepreneur.
Each offer contains information such that it is clear to the consumer what the rights and obligations are related to the acceptance of the offer. This particularly concerns:
the total price including tax
any delivery charges
whether the right of withdrawal is applicable or not
the method of payment, delivery or performance of the contract
the acceptance period of the offer, or the period for adhering to the price
6. The agreement
The agreement takes effect at the moment the consumer accepts the offer and meets the conditions stipulated therein.
If the consumer has accepted the offer electronically, the professional will immediately confirm receipt of the acceptance of the offer electronically. As long as the receipt of this acceptance has not been confirmed, the consumer may dissolve the contract.
If the contract is concluded electronically, the entrepreneur takes appropriate technical and organisational measures to protect the electronic transfer of data and ensures a secure web environment. If the consumer can pay electronically, the entrepreneur must observe appropriate security measures.
The contractor may - within the limits of the legal framework - verify whether the consumer can meet their payment obligations, as well as all relevant facts and factors for a responsible conclusion of the distance contract. If, based on this investigation, the contractor has good reasons not to conclude the agreement, they have the right to refuse an order or request or to attach the execution to specific conditions, while justifying their decision.
The contractor shall provide the following information with the product or service supplied to the consumer, in writing or in a manner that allows the consumer to retain it in an accessible form on a durable data medium:
the conditions under which and the manner in which the consumer can exercise the right of withdrawal, or a clear statement on the exclusion of the right of withdrawal;
the information on after-sales services and existing warranties;
7. Right of withdrawal upon delivery of products
When purchasing products, the consumer has the option to dissolve the agreement without giving reasons within a period of 14 days. This period begins the day after the consumer receives the product or on their behalf.
During this period, the consumer will handle the product and its packaging with care. They will only unpack or use the product to the extent necessary to assess whether they wish to keep it. If they exercise their right of withdrawal, they will return the product to the contractor with all delivered accessories and - if reasonably possible - in the original condition and packaging, in accordance with the reasonable and clear instructions provided by the contractor.
8. Costs in the event of withdrawal
If the consumer exercises their right of withdrawal, they bear at most the costs of returning the goods.
If the consumer has paid an amount, the entrepreneur shall refund this amount as soon as possible, but no later than 30 days following the return or withdrawal.
9. Exclusion of the right of withdrawal
If the consumer does not have a right of withdrawal, this can only be excluded by the professional if they have clearly indicated it in the offer, at least in good time before the conclusion of the contract.
The exclusion of the right of withdrawal is only possible for products:
that deteriorate or age rapidly.
Whose resale as a new product is impossible if the cellophane packaging has been opened or removed.
10. Compliance and warranty
The professional guarantees that the products and/or services comply with the contract, the specifications indicated in the offer, the reasonable requirements of durability and/or ease of use, and the legal provisions and/or government regulations in force at the date of conclusion of the contract.
An arrangement offered as a warranty by the professional, the manufacturer or the importer does not affect the rights and claims that the consumer may assert against the professional based on the law and/or the distance agreement regarding a breach in the performance of the professional's obligations. The warranty does not apply if:
the item or device has not been sufficiently protected from damage related to transport during its return.
modifications have been made to the article
defects have appeared due to incorrect or abusive use
the defect was caused by intent or gross negligence
an external calamity such as a natural disaster, etc.
11. Delivery and execution
Art and Disc Store takes the utmost care in receiving and executing product orders and in assessing service requests.
The delivery location is the address that the consumer has provided to the company.
The company will execute accepted orders as quickly as possible, but no later than 30 days, unless a longer delivery time has been agreed. If delivery is delayed, or if an order cannot be executed or can only be partially executed, the consumer will be informed no later than one month after the order. In this case, the consumer has the right to dissolve the agreement at no cost and the right to any potential damages.
In the event of dissolution in accordance with the previous paragraph, the contractor will refund the amount paid by the consumer as soon as possible, but no later than 30 days following the dissolution.
If the delivery of an ordered product proves impossible, the contractor will endeavour to provide a replacement item. No later than at the time of delivery, it will be clearly and understandably indicated that a replacement item is being delivered. For replacement items, the right of withdrawal cannot be excluded. Return costs are to be borne by the contractor.
The risk of damage and/or loss of the products is borne by the contractor until the moment of delivery to the consumer, unless otherwise explicitly agreed.
12. Additional or different provisions
The additional or derogatory provisions to these general conditions may not be to the detriment of the consumer and must be recorded in writing or in a manner that allows the consumer to keep them in an accessible format on a durable data medium.
13. Right of withdrawal
The professional refunds all payments made by the consumer, including the delivery charges billed by the professional for the returned product, immediately but within 14 days following the day on which the consumer notifies him of the withdrawal. Unless the professional offers to collect the product himself, he may wait to make the refund until he has received the product or the consumer proves that he has returned the product, with the earliest date being retained. The contractor uses the same payment method as that used by the consumer for the refund, unless the consumer agrees to another method. The refund is free for the consumer. If the consumer has chosen a more expensive delivery method than the cheapest standard delivery, the contractor is not obliged to refund the additional costs related to the more expensive method.
Returns
You have a period of 15 days to return a product still wrapped in its cellophane. This 15-day period starts from the moment you receive the package.
